MC Mong

25 May:

MC Mong‘s 18 month-long legal affair has come to its final stages. Back in April of 2011, MC Mong received a suspended sentence (probation) for one year. He filed an appeal but the courts ruled against the appeal.
After a grueling fight, MC Mong sent a short text message to his agency family saying , “You worked hard“. He expressed both his appreciative and remorseful feelings with just these few words.
An associate of MC Mong commented, “After the appeal of the defendant was dismissed, we informed MC Mong of the result. And because of the situation and his personality, he just said ‘You worked hard’ and nothing more.
Despite the defendant’s efforts in appealing the ruling, the final verdict didn’t waver from the original sentence. MC Mong’s one year suspended sentence (probation) was upheld and he must also serve 120 hours of community service. If he violates his probation he will face 6 months of imprisonment.
MC Mong’s representatives stated, “MC Mong is going to humbly accept his sentencing but he will not be having a press conference regarding his thoughts on this incident.” They also added, “MC Mong will always be remorseful towards his fans. He feels he is forever in debt to his fans, and will spend the rest of his life making it up to them.
Previously, MC Mong was found guilty by the Court of Appeals for intentionally trying to delay his military service, but not guilty for charges that he extracted his own teeth in an effort to dodge conscription.

23 May:

MC Mong, who is currently on trial on suspicion of dodging the military draft will receive his final judgment in the near future.
MC Mong is on trial for trying to get out of his mandatory duty to serve in the military. The trial before the Supreme Court will begin on May 24th.  It seems as though there will finally be a resolution to this long ordeal.  On this day, only the evidence and written documents will be reviewed so MC Mong does not need to personally appear.
A representative from MC Mong’s agency stated that they will quietly follow whatever decision is made.  Currently, there are no plans whatsoever of a comeback.  If the Supreme Court does not overrule the ruling laid down by the lower courts then MC Mong must fulfill his punishment of community service.
Through ‘Win Win‘ Baek Ji YoungHahaLee Soo Geun and others have shown their support and given encouragement to MC Mong. Even netizens are wondering how he is doing these day. Thus, it seems that many people will be paying close attention to the final judgment.
Last November, MC Mong was found guilty by the Court of Appeals for intentionally trying to delay his military service, but not for charges that he extracted his own teeth in an effort to dodge conscription.  Because of this the prosecution has taken this matter up to the Supreme Court.  They are seeking review of only the charge that MC Mong had his teeth removed to avoid the draft.
MC Mong is charged with dodging the draft, but not held in physical detention.  If what the lower court’s judgement is upheld, then he would have to serve 6 months in prison, 1 year of probation, and 120 hours of community service.

1 Mar:

MC Mong will be attending his final appeals hearing at the Supreme Court next month.
Back in January, after a long battle in the courts over the military draft evasion case, a verdict was reached for MC Mong. The court upheld the previous ruling reached back in April 2011, as they found MC Mong ‘not-guilty’ of violating Korea’s military service law, for it couldn’t be proven that his teeth was extracted for the purpose of evading his military draft. However, the court found him guilty on obstruction of justice charges for delaying his military enlistment without a valid reason. MC Mong was sentenced to a suspended six-month prison term, a year of probation, and 120 hours of community service.
Although MC Mong had expressed that he would not be following up with another appeal, and would accept the decision by the court. The prosecution had decided to appeal, for they could not accept MC Mong’s ‘not-guilty’ verdict on the account of violating Korea’s military service law. As a result, MC Mong will be heading back to the court in March for the final appeals hearing.
The case began back in October of 2010, and so far every verdict reached has deemed MC Mong ‘not-guilty’ on the charges of violating military service law, but guilty on the obstruction of justice charges.

23 November:

It seems that MC Mong‘s military draft evasion case has finally come to a close.
After a long, tedious battle in the courts, the singer has decided to accept the decision made by the court of appeals, and has given up  appealing a second time.
MC Mong’s agency told Star News on November 23rd, “We have decided to accept the court of appeals’ decision, and have made the final decision of not appealing to the Supreme Court. MC Mong had until the 23rd to submit an appeal to the Supreme Court, however, he has decided to humbly accept the decision.”
With this news, the verdict from the court of appeal (which is the same as the original one he received) will uphold his sentence of 6 months jail sentence suspended up to 1 year and 120 hours of community service.

To recap: Back in April, the court’s verdict found MC Mong ‘not-guilty’ of violating Korea’s military service law, for it couldn’t be proven that his teeth was extracted for the purpose of evading his military draft. However, the court found him guilty on obstruction of justice charges for delaying his military enlistment without a valid reason. MC Mong was sentenced to a suspended six-month prison term, a year of probation, and 120 hours of community service.
The drama continued in the court of appeals, as MC Mong’s representatives argued that he was unfairly judged on his obstruction of justice charges, and therefore requested an appeal. The prosecution was also unhappy with the court’s verdict, as they believed that he was intentionally trying to evade mandatory military service. Since they could not accept the court’s decision of ‘not guilty’ for those charges, they had requested an appeal as well.
Last week, the court of appeals reached a verdict, which was the same as the original one the singer had received. Rather than fighting the decision once more with a second round of appeals, MC Mong has decided to accept the court’s decision, and has thus brought this case to a close after a year.

21 November:

The November 19th episode of KBS 2TV ‘Entertainment Relay‘ covered the story of MC Mong whom the courts found guilty of obstruction of justice for attempts of delaying his military enlistment, but not on the account of violating military service.
When reporters asked his management company what his current condition was like, they revealed that MC Mong was not in contact with anyone at the moment.
They added, “The 1N2D cast members as well as other celebrities have tried to contact him, but have been unsuccessful“.
And when asked if he has been receiving treatment for his physical & mental well being, his management responded, “He has developed so much social anxiety that he is not even seeking the medical attention he needs“, further revealing the emotional and mental stress the rapper is currently under.

16 november:
After many court sessions, MC Mong has finally received a verdict from the appeals court for charges related to evasion of mandatory military service.

On November 16th, The court found MC Mong guilty of obstruction of justice for attempts of delaying his military enlistment, but not on the account of violating military service. The verdict called for a 6-month jail sentence (suspended for 1 year), and 120 hours of community service.
The verdict reached today is the same as the original verdict MC Mong received last year on April 11th. He was found guilty of delaying his military enlistment, but prosecutors were unable to prove whether he had extracted teeth with the intention of evading military service. He was also given the same amount of sentence (6 months jail suspended for 1 year, and 120 hours of community service).
MC Mong updated his Twitter for the first time in over a year, and expressed his position on the whole ordeal.
“I’m sorry for her causing you all distress for over a year with the articles and cases about me, which you probably didn’t want to see. What could I dare say?
I’m sorry and sorry. I’m a foolish, idiotic, and a thick-headed guy. What could I dare say? I’ve made this mess so I will carry the penalty for the rest of my life. Even if I get painfully punished, this is all  my fault, and I won’t blame anybody else. Also, it’s my fault for trying to only reveal the things I didn’t do.
There are so many things I want to say, but what right do I have to say anything. It is all my fault. The love I received from all of you was too great and felt like heaven. I was sincere in whatever I did to make the audience laugh on programs and when I sang on stage.
I used to like people so much, but now I can’t even look people in the eyes. The love you all showed me in the past has really been an honor. I will volunteer in a place that is darker than I am, and live a different life, and consider that to be happiness.I am truly truly sorry. I’m sorry. I apologize.”

19 October:

On October 19th, MC Mong attended his fourth court of appeals trial for charges related to evasion of mandatory military service. While his third appeals trial involved testimony from the dentist who extracted his teeth, the fourth trial brought the person who introduced MC Mong to the dentist onto the witness stand.
After the witness was questioned, MC Mong gave the following speech for his final argument:
“Over the past two years, the issue of being guilty or not guilty no longer seemed important. I’m a person who used to really like people, but I haven’t been able to leave my house this entire time. I can’t make eye contact with anyone. I have become more and more heartsick, and I feel as if I’m already dead. I don’t know how much I have to keep speaking until people believe me. It’s all my fault, and it’s so exhausting.
I don’t hope to be able to return to the entertainment industry… I just want to meet people I like and spend the rest of my life serving others and asking for forgiveness. I just want to live like a human being.
MC Mong also revealed his dad’s medical history that he had kept hidden until now. “I didn’t even think I would be able to enter military service as an active soldier… My father is visually impaired and I have also been diagnosed with glaucoma in both eyes. I’ve always thought since I was young that I would not be a candidate for active military duty.”

21 September:

Looks like MC Mong is back to square one with his mandatory military service evasion trial, as he headed back to court on the 21st for the third time.
MC Mong (birth name: Shin Dong Hyun) went back to court for his third appeals trial after being under suspicion of extracting teeth as a way of evading Korea’s mandatory military service. The only extracted tooth in question is tooth number 35, and the dentist (Dr. Lee) who reportedly removed it stood as a witness.
After attempting to treat the tooth, Dr. Lee extracted tooth number 35 in December of 2006. “We calculated how many and which teeth needed to be missing in order for him to be considered exempt from military duties, and he was eligible even without removing number 35.” When asked their reasons to precalculate in the first place, he replied, “We talked about removing the tooth; it would have caused him pain in the long run.”
During the initial interrogation, Dr. Lee brought forth his attorney for the case, and it was revealed that the attorney would also be representing MC Mong himself. In regards to this situation, Dr. Lee remarked he had “no idea” and that he “hasn’t paid the legal fees to the attorney yet, as the attorney is an acquaintance” of his.
Back in April, the court’s verdict found MC Mong not-guilty of violating Korea’s military service law. However, the court found him guilty on obstruction of justice charges. Mong was sentenced to a suspended six-month prison term, a year of probation, and 120 hours of community service. The court stated, “Due to his difficult financial situation and fear of dental treatment, his dentists decided it would be best to extract the tooth.”
MC Mong’s representatives argued that he was unfairly assessed on his obstruction of justice charges therefore requested an appeal, and the prosecution accused him of intentionally trying to evade mandatory military service and also requested an appeal.

20 July:
MC Mong returned to court on July 20th to begin his trial of appeal. He was previously in court following charges for suspicion of willfully evading mandatory military service.

MC Mong’s original trial opened on April 11th, 2011. The court’s verdict found MC Mong not-guilty of violating Korea’s military service law. However, the court found him guilty on obstruction of justice charges. Mong was sentenced to a suspended six-month prison term, a year of probation, and 120 hours of community service.
Since that trial, MC Mong expressed that he would like to enlist in the military, even seeking alternative methods to enter. But an official statement issued by the Office of Legislation & the Interpretation of Law Reviewing Committee found that although MC Mong was found not guilty of violating the military service law,  he was no longer eligible to volunteer for active duty because of his mature age. Therefore, he cannot enlist in the military.
Prosecutors could not accept that MC Mong was found not guilty of violating the military service law in the first trial. Instead, they requested an appeal of the lower Court’s ruling, to which MC Mong consented.
The Court of Appeals trial begins today at 10:00AM in an undisclosed Seoul courthouse. Legal experts anticipate another highly intense trial between MC Mong and prosecutors over charges that MC Mong evaded military service and other issues of law.

19 April:
On April 19th, rapper MC Mong held his official press conference at the Grand Hilton Hotel in Hongeun-dong and revealed his feelings to an audience of 200 reporters on his trials that have been taking place for the past 10 months.

His report was as follows:
“I would like to begin by apologizing to the citizens of Korea for disturbing society. All this while, I’ve been running according to so many schedules, and it’s true that I had fear of enlisting in the army. The enlistment of a celebrity is taken very sensitively by my agency, so I had no option but to follow their decisions.
However, I have absolutely no excuses to make in the face of the thoughtless way I handled my duty to national defense.  I would like to apologize once more time.
It is not true that I brought damage to my teeth in order to earn an exemption from the military.
On the internet post that netizens discovered, I would like to say that it was just written from the viewpoint of one man out of the many that must enlist. If I had truly seeked a way to earn an exemption, I would not have written it under my own ID. At the time I wrote the post, I did not think that it would bring about such big misunderstandings.

I had left my teeth in pain for so long that the pain just became a part of my life. It was hard at first because of the financial difficulties my family was going through, as well as my busy schedule, which didn’t warrant any time for me to get treatment. I was also embarrassed about the fact that I was in pain.
Under the advice of my dentist, who told me that my teeth would not only give me aesthetic problems, but dentrimental to my health as well, he put in nine needles while under a general anesthesia.  He had told me that it wouldn’t hurt if I was under general anesthesia, so after much hesitation, I agreed to the operation. However, I have not gotten not even one implant since that procedure, and am just living with needles.
Because I believe that I must do my best for the people that love me, I have been taking full participation in investigations. Unfortunately, I do feel that I am guilty against the citizens of this nation for inflicting such wounds. This is not an attempt to earn popularity or public sentiment. I merely want to be confident with myself in the face of my duties to our national defense.

In order for myself to enlist in the army, I must be judged guilty, but I cannot say I did something that I did not do. That is why, at this moment, I am unsure of what decision I need to make. I can’t do this and I can’t do that.
I’ve undergone a lot of trauma and pain through my trials, but it was an opportunity for me to grow. I will be working against my arrogance with the heart of dedication in order to fill what I lack. I would like to apologize once again for harming the hearts of our nation’s people, as well as my industry seniors and juniors.”

11 April:
Rapper MC Mong’s infamous legal battle over accusations of intentional draft dodging finally came to a close on April 11th. The verdict? MC Mong has been sentenced to six months of imprisonment, probation for one year, and 120 hours of community service.

The court acknowledged that there was a delay in his military enlistment, however, they were unable to determine whether the star was guilty for extracting teeth for the purpose of avoiding his military draft.
Investigators came forward to state, “We were not convinced that he didn’t know of his delayed enlistment, and we are certain of our conclusions and subsequent charges.”
So would MC Mong have to serve with the military later in the future?
A representative of the Office of Military Manpower Administration stated, “Although he has been convicted for interfering with a government official in the execution of his duties, he was cleared on accusations of violating military service laws. Therefore, the Military Manpower Administration cannot take further action. He must be convicted of charges for violating the military service act in order to be elligible for a draft retest. The exempt status is still valid for this case.”
Regardless of the verdict, MC Mong has suffered greatly physically and emotionally since the trial begun and an uncertain future awaits him in the entertainment scene.

28 Maret:
Since last year, MC Mong has been attending trials back and forth due to his alleged draft dodging. Today, on March 28th, the court held the closing argument process.

During the trial today, the prosecutors questioned the singer, who seemed to have poured out all the burden that he had been keeping inside for the past months.
He stated in tears, “It was hard to live when this whole thing surfaced. I really had no clue about the rumors that I was fabricating my enlistment issues, but I won’t be changing the words that I have said up till now. Something that is wrong was definitely not done. I am very sorry and hurt for those who have been disappointed with me. I am not doing this to restore my reputation, or for money and fame. I am woeful. I sometimes even get thoughts that I have actually done something wrong, but I am not a liar and I will take whatever decision they choose.”
After revealing his inner feelings, MC Mong wiped off his tears and left the site.
At the same court, MC Mong’s final trial will be held on April 11th, where a decision will finally be made.

8 Maret:
MC Mong’s dentist revealed to the press that the police interrogated him unlawfully, and asserted that his past confessions were falsified. Rapper MC Mong is currently under investigation for trying to dodge Korea’s mandatory military service, and his dentist attended his fifth trial and served as a witness.
While on a TV broadcast, Dentist Jung previously claimed that he received 80,000,000 won from the star for keeping the letter about MC Mong’s ‘intentional’ teeth extraction a secret.
However, during the trial, Jung said, “The reported content of the letter is far from the truth” and denied that the broadcast was true. He added, “I just wrote what the police told me to write at that time. Although MC Mong’s teeth were in terrible condition, I did not tell him to get them extracted. The money that I received came from the money I invested in MC Mong’s online shopping mall“.
He also complained about the harsh nature of the investigation, and added that the police was trying to create false stories. Dentist Jung is currently serving a sentence for drug possession, and elaborated that, “During the investigation, the police forced me to ‘confess’ the truth about MC Mong’s teeth. They also told me that they would give me a plea deal if I gave a good eyewitness account. The police came many times and interrogated me during the time when MC Mong let down his guard and claimed his innocence. They also said that my dental license could be taken away“.
MC Mong’s sixth trial is set to commence at 2:00 PM on March 28th. He is set to make his final defense during the trial.

8 Februari:
MC Mong attended his fourth trial on February 8th at the 519th Seoul Central District Court.
To recap, the prosecution is asserting that MC Mong had extracted his teeth with the intention to dodge his military draft. In this fourth trial, a witness by the name of Lee was examined, as he was the dentist responsible for extracting a tooth from MC Mong.
Lee revealed that the entertainer came to him on November 12th, 2006, and that he personally suggested to MC Mong that his tooth should be removed. He stated, “Before I extracted tooth no.35, MC Mong was already exempt from the military.  I suggested that he extract it, and he agreed.”
He continued, “At the time, his tooth was in severe condition, which required endodontic treatment.  During his second visit, he asked how he could receive a medical diagnosis for soldiers; he also revealed that a tooth he previously treated was giving him pain. After checking, we decided to extract it.”
Lee revealed that MC Mong was missing 10 teeth at the time, and wondered whether extracting another one would exempt him from the military. In any case, the original tooth he was looking at was discovered to be in such a deteriorated state that it required an extraction.
Lee then downloaded a score guide for exemptions and found that MC Mong would have been already eligible prior to the tooth’s extraction, which further demonstrated that MC Mong received treatments out of pain, and not with the intention to draft-dodge. Lee revealed, “I told MC Mong that he was already eligible, but he showed no response.”
MC Mong’s legal representatives added, “The medical certificate for soldiers is a document required for his physical test – it’s not a document one asks for when in need of an exemption.”
